SMS — Mobile Message Service Terms & Conditions

These SMS Terms & Conditions ("SMS Terms") govern your participation in the Factory Direct Enterprises SMS text messaging program (the "Program") operated by Factory Direct Enterprises, LLC, doing business as Ashley® ("Factory Direct Enterprises," "FDE," "we," "us," or "our"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). By opting in to or participating in the Program, you agree to these SMS Terms.

Program Description

By enrolling in the Program, you agree to receive recurring SMS/text messages from Factory Direct Enterprises SMS to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.

Messages may include, for example:

  • Promotional offers and sales
  • Store events and announcements
  • Customer service communications
  • Order/delivery updates and related notifications (if applicable)
  • Account alerts and informational updates

Message content may vary. We may modify or cancel the Program or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

How to Opt In

You can opt in to Factory Direct Enterprises SMS through one or more of the following methods:

  • Web (e.g., website form/landing page)
  • In-store (e.g., in-store sign-up form or tablet)
  • Email (e.g., a link from an email to an SMS opt-in form/landing page)
  • QR code (e.g., scanning a QR code that links to an SMS opt-in page)

By opting in, you expressly authorize Factory Direct Enterprises to send recurring text messages to the mobile number you provide, including by automated technology (where permitted by law).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Factory Direct Enterprises. Your participation in this program is completely voluntary.

CONSENT IS NOT A CONDITION OF PURCHASE.

You confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in. By providing your mobile phone number and opting in, you consent to the use of an electronic record to document your opt-in.

Message Frequency

Message frequency varies based on your interactions with us, subscriptions, and the Program's messaging cadence.

Costs / Message and Data Rates

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. Your mobile carrier may charge fees for sending or receiving text messages. Charges are billed by and payable to your mobile carrier. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

Supported Carriers and Delivery

The Program is available on most major U.S. wireless carriers. Factory Direct Enterprises does not guarantee availability on all carriers or devices. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. Factory Direct Enterprises is not responsible for any undue delays, failure of delivery, or errors in messages.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the Program with your new number.

How to Opt Out (STOP)

You may opt out of the Service at any time. Text the single keyword command STOP to cancel. After you text STOP, we will send a one-time opt-out confirmation text message and you will no longer receive SMS messages from the Program, unless you re-enroll.

We also recognize the following common opt-out keywords:

END, CANCEL, QUIT, UNSUBSCRIBE

Please note: the text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command, and neither we nor our service providers will have any liability for failing to honor such requests.

These SMS Terms shall continue to apply even if you opt out of the Service.

We do not sell personal information.

Mobile information and opt-in consent data will not be shared or sold to third parties for their marketing or promotional purposes. We may share your information, including your SMS opt-in or consent status, only with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

Data obtained from you in connection with this Service may include your cell phone number, your carrier's name, and the date, time, and content of your messages and other information that you may provide. We use this information to contact you, provide the Service, and to otherwise operate and improve the Program.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to participate in the Program, or have the permission of a parent or guardian. By opting in, you represent and warrant that you meet this eligibility requirement.

Changes to the Program or These Terms

We may change or discontinue the Program or update these SMS Terms at any time. Updates will be posted on this page with a revised Effective Date. Continued participation after changes become effective constitutes your acceptance of those changes.

Disclaimers / Limitation of Liability

THE PROGRAM IS PROVIDED ON AN "AS IS" BASIS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, Factory Direct Enterprises WILL NOT BE LIABLE FOR FAILED, DELAYED, OR MISDIRECTED DELIVERY OF ANY INFORMATION SENT THROUGH THE SERVICE, ANY ERRORS IN SUCH INFORMATION, AND/OR ANY ACTION YOU MAY OR MAY NOT TAKE IN RELIANCE ON THE INFORMATION OR SERVICE.

The Program may not be available in all areas at all times. Delivery of messages is subject to effective transmission from your wireless carrier and is outside of our control.
