Congratulations on your purchase of Ashley Furniture! You have just purchased the best furniture available for the price. With proper care, your new furniture should provide years of dependability and beauty. The items in our showroom represent the finish, tailoring, and quality of the merchandise you will soon receive. This Agreement ("Agreement") provides the terms and conditions agreed upon by you and us.
Delivery Information

Delivery Dates and Time Windows
Orders scheduled for Home Delivery will be delivered on the date agreed upon at the time of purchase. To provide you with the best delivery experience, notifications are sent via text, phone, or email within 72 hours of delivery to confirm the date. Additionally, you will be provided with a 4-hour time window within 36 hours of your scheduled delivery. We are unable to accommodate alternative time window requests due to routing logistics. In the event you are not home to accept delivery a $99.00 re-delivery fee will apply, and your original delivery fee is non-refundable. All product availability is based on manufacturing information available to us at the time of purchase.
If a scheduled delivery date was confirmed at the time of sale, we will notify you if this date needs to be changed. If, based on product availability, your purchase was not eligible to schedule a confirmed delivery date at time of sale, you will receive an estimated availability date instead. Once the product arrives at our distribution center, we will contact you to schedule delivery. Estimated dates are subject to change and are not routinely communicated. Some orders may ship in multiple deliveries based on item availability.
Acceptance of Delivery
On the day of your delivery, you will receive a call prior to arrival. All existing furniture must be moved/removed, and pathways must be clear to ensure unobstructed access for our delivery team.
A responsible adult (18 years or older) must be present to accept and sign for your delivery. Merchandise will not be left at a delivery address if unattended or if a signature cannot be obtained. Customers must inspect items for visible defects or damage at the time of delivery. Claims for visible damage reported 72-hours after delivery/pick-up cannot be honored.
Building Restrictions and Walkups
If you live in a housing community, complex, or building, you are responsible to inform the trusted advisor of any building restrictions or necessary Certificate of Insurance (COI), so that we may prepare accordingly. If delivery is not able to be made due to missing necessary COI information, a redelivery fee will apply. Your standard delivery fee includes upstairs deliveries up to 3 floors. There is a fee of $10 per piece per floor if delivery requires a walk up to floors 4 or 5. The delivery team is not responsible for any deliveries over the 5th floor.
Delivery Damages
All furniture is handled with care, however, in the unlikely event something happens, we have you covered. In the event of any accidental damage to either your furniture or home during delivery, photos of the damage will be taken by the delivery team. A prompt resolution of the situation will take place based on the extent of damage. Our skilled resolution specialists will review the following options with you:
- An Ashley Certified specialist will be scheduled to perform an in-home service to bring your furniture up to showroom standard.
- The delivery team will take back the damaged item and a replacement will be scheduled for delivery. Due to the risk of further damage occurring most damaged items cannot be left in the home unless you opt for in-home service.
- If there is damage to the home, our Claims Department will review all information including pictures and repair quotes and work with you on a prompt resolution. To initiate a claim, please email claims@ashleyne.com.
If an item does not fit at the time of delivery:
- You can refuse an item but please note that delivery charges are non-refundable, or
- You can return to the showroom to reselect another item but a second delivery charge will be applied, or
- We offer a guaranteed in-home delivery service (GTD), in certain geographic areas, as an option with additional applicable fees, or
- If you choose to cancel the order, the original delivery fee is non refundable.
Order Modifications/Cancellations
Order Changes/Modifications
All orders go through a thorough quality control process which starts 72 hours prior to delivery. Orders may be changed/modified up to 72 hours before the scheduled delivery date. Exceptions may be made on a case-by-case basis within 72 hours of delivery; however, please note this may change your delivery date and a $99.00 re-delivery fee will apply.
Order Cancellations
Due to our quality control process, delivery fees are non-refundable for any full order cancellation within the 72-hour window.

Call Ahead
You are required to call the number listed (732-548-1234) and confirm your pick-up 1-hour prior to arriving at the warehouse to ensure your merchandise is available and ready for pickup upon your arrival. Failure to call ahead can incur a longer wait time.
What you will need
You or the person picking up on your behalf are required to provide non-expired ID at the point of pick up to verify your purchase. We will be pleased to assist you in loading but you are responsible for securing the load.
Pickup Damages
We are not responsible for any damage to the vehicle or furniture while loading merchandise or incurred during the hauling process and cannot be responsible for any damage after leaving the premises. Furniture will be packaged, and no additional assembly will be provided by us.
Once picked up, all merchandise is final sale and returns for a full refund are not accepted.
The 3R's – Returns, Reselections and Refunds
Returns
Returns for a full refund are not allowed after items have been accepted during delivery, picked up from our store or distribution center, or direct shipped to home.
Reselections
If you are unhappy with the look or feel of your merchandise, a reselection may be available for items of equal or greater value. Preference concerns must be reported within 30 days of delivery; concerns reported after 30 days will not be eligible. Adjustable bases, foundations, items delivered via guaranteed in-home breakdown service, items purchased "as-is" or as floor samples, and orders paid using rent-to-own or leasing options are not eligible.
All reselections are subject to restocking and delivery fees. Restocking fees apply in all cases and may increase the longer merchandise remains in the home, so customers are strongly encouraged to report any concerns as soon as possible. If a reselection is approved, a delivery fee will apply to the replacement item(s). All applicable fees must be paid out of pocket. The original merchandise will be collected at the time the replacement item(s) are delivered.
Refunds
Refunds may be issued in connection with approved changes or modifications to an order; however, certain items and orders are excluded and may not be eligible for modification or refund. Cash payments will be refunded by check within 14 days. Credit/Debit Card payments will be credited back to the original card.
Special Orders/Floor Samples/As-Is/Layaway
Floor Samples/Clearance Items/Take with Items
Floor sample and clearance merchandise are sold "As-Is" and are non-refundable nor are covered by manufacturers' limited warranties. Items taken from the store like accents and bedding accessories (Take-with items) are non-refundable after leaving the store. All sales are final.
Special Order Merchandise and Direct ship merchandise, including table pads, cannot be cancelled or refunded after the order is placed.
TEMPUR-Pedic direct shipments require a non-refundable $300 down payment.
Outdoor Furniture
Guests are responsible for installation of gas/propane connections with fire pits or patio heaters and assembly of outdoor swings.
Layaways
We accept Layaways purchases but require a minimum of $100 down payment and payments to be made every 30-days.
- If no additional payment is made beyond the deposit for 90-days and the deposit is less than 50%, the sale will be cancelled
- If 50% or more is paid and there is no activity for 120-days, the sale will be cancelled
- All deposits from cancelled Layaway sales are NON-REFUNDABLE and will remain on your account as Store Credit
Warranty and Protection
We offer a 1-year limited Manufacturer Warranty beginning on the original date of delivery. This warranty applies to manufacturer defects ONLY (lamps, rugs, accessories, and fire pit tables are not included). Floor sample, take with, and clearance merchandise are sold "As-Is" and are non-refundable nor are covered by manufacturers' limited warranties.
During the 1-year warranty period:
- We reserve the right to service, rather than exchange, the merchandise at no cost to the guest.
- Services are only offered for manufacturer defects and items cannot be moved from the original location where they were delivered.
- Services may include part orders and repairs will be performed by one of our certified specialists.
- If repairs can be made, you are not entitled to any exchanges or reselections, and we reserve the right to properly verify the condition and nature of any damages before offering service.
- Merchandise repaired is still covered for the remainder of your 1-year Manufacturer warranty period.
- If furniture must be replaced and your replacement item does not match the other piece(s) of the same collection, we will offer you a one-time option to replace the other piece(s) of your collection with a 25% restocking fee.
This limited warranty applies exclusively to the original purchasing guest at the original address where the merchandise was delivered. Please contact us to request a copy of the full warranty. Limited warranties do not apply to rented, business, commercial, institutional, or other non-residential uses. Other warranty limitations may apply. Warranty claims must include the original receipt and all must be made in writing prior to the 1-year warranty expiration period.
Wear and Tear
This limited warranty does not cover damage resulting from normal wear and tear, abuse, neglect, misuse, accidents or from damage resulting from improper use, care, or storage.
Pilling
Fabric pilling is a common occurrence in furniture. It is not a fabric defect or fault from the manufacturer. Fabric pilling will go away once the excess loose fibers that cause pilling are gone and does not hurt the durability or functionality of the fabric. Pilling can also be removed with a pill shaver.
TO THE EXTENT PERMITTED BY LAW, WE MAKE NO OTHER EXPRESS WARRANTY WITH RESPECT TO THE GOODS AND EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND ALL WARRANTIES ARISING FROM COURSE OF CONDUCT, COURSE OF DEALING OR CUSTOM OF TRADE. WE WILL NOT BE RESPONSIBLE FOR ANY DAMAGE, CHANGE OR EFFECT TO THE GOODS RESULTING FROM OR RELATED TO ANY OF YOUR ACTS OR OMISSIONS, YOUR AGENTS OR CUSTOMERS. THIS INCLUDES BUT IS NOT LIMITED TO FAILURE TO YOUR PERFORMING THE REQUISITE MAINTENANCE AS PROVIDED IN THIS AGREEMENT. NONE OF OUR REPRESENTATIVES IS AUTHORIZED TO MAKE ANY CHANGES OR MODIFICATIONS TO THESE LIMITED WARRANTIES. IN NO EVENT WILL WE BE LIABILE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES FOR PERSONAL INJURY, LOST PROFITS OR PROPERTY DAMAGES RESULTING FROM THE USE OF THE GOODS SOLD BY US TO YOU.
Protection Plan
Customers may choose to purchase an independently administered Extended Protection Plan at the time of sale. While the seller permits customers to purchase the plan through our point of sale, the plan is offered, underwritten, and administered solely by Risk Assurance Partners. All coverage terms, benefits, exclusions, claim procedures, decisions, and service obligations are exclusively governed by Risk Assurance Partners' official contract, which will be provided directly by the administrator within 30 days of purchase. The seller's role is strictly limited to facilitating the purchase transaction. The seller does not administer the plan, determine coverage, handle claims, provide services, or make any representations regarding the scope of coverage or eligibility for benefits. The plan becomes effective only upon the customer's purchase and acceptance of the administrator's terms and conditions. All claims must be submitted directly to Risk Assurance Partners in accordance with their procedures. By purchasing the plan, the customer agrees that the terms of the third-party administrator govern all rights and obligations related to the Extended Protection Plan, subject to applicable consumer protection laws.
Mattresses
Mattresses, foundations, and adjustable bases are available in multiple heights and will affect the overall profile of the bed based on the combination selected. Please review your new configuration prior to delivery to ensure the proper combination has been selected based on your height preferences. Mattresses, foundations and bases cannot be returned or exchanged post-delivery due to legal and sanitary reasons.
California King–sized bedding products, including but not limited to mattresses, foundations, and adjustable bases, are considered final sale at the time an order is placed. Due to the custom and special-order nature of these items, orders cannot be canceled, modified, returned, or refunded once submitted.
Mattress impressions of up to 1.5" on standard mattresses and 0.75" on a hybrid mattress are normal and not considered defective by the manufacturer. A mattress break-in period is expected with all mattresses, on average this period is around 30 days, but can take more or less time depending on the style of mattress and individual sleeping habits. Please refer to your manufacturer's warranty card for more information.
Mattress and/or adjustable base defects may need to be serviced directly by the manufacturer. Please contact our customer service department so we can provide the proper contact information.
Many manufacturers offer mattress warranties; however, such warranties may be deemed void if:
- The mattress is not continuously supported by an appropriate foundation manufactured by the mattress manufacturer, platform, or bed frame, including center support where required, and slats/support beams are spaced greater than 4 inches apart.
- The mattress is placed on an inadequate or structurally unsound support system.
- The mattress is dirty, stained, soiled, unsanitary, or otherwise abused.
- Mattress law tags have been removed.
Select mattress brands have a 90-day Comfort Fit Guarantee with disposal fees. Ashley brand mattresses are NOT eligible. For mattresses that are eligible:
- Claims must be filed between 31-90 days and reselection fees will apply.
- A mattress protector must be purchased at the time of purchase to be eligible for reselection or comfort policy.
No Compensation Obligation
All products are sold as new unless otherwise stated. In the event a product is damaged during delivery or otherwise, Ashley may, at its sole discretion, offer a remedy such as replacement or repair.
Except as expressly required by applicable law, Ashley does not provide compensation for delivery issues, inconvenience, delays, dissatisfaction, or damage beyond the remedy offered. Once a replacement, partial refund, or other resolution has been provided, such remedy shall constitute full and final resolution of the issue, and Ashley shall have no further obligation to provide additional compensation, refunds, or credits.
Any exception, accommodation, or courtesy extended by Ashley shall not constitute a waiver of these Terms or establish a precedent for future claims.
Miscellaneous
No terms or conditions other than those stated in this Agreement will be binding on us unless those modifications or additional terms are made in writing and executed by us. The terms and conditions of this Agreement will supersede any different or conflicting terms in any other documents. Acceptance by us of your order is expressly limited to the terms and conditions contained in this Agreement. If any provision of this Agreement is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from the Agreement and will not affect the validity and enforceability of the remaining provisions. The invalidity in whole or in part of any provision hereof will not affect the validity of any other provision. Except where a remedy is expressly stated to be the exclusive remedy, our rights and remedies will be cumulative and in addition to any other rights or remedies provided by applicable law or equity. Your rights and obligations may not be assigned, nor can they be delegated without our prior written consent. The terms and conditions contained in this Agreement and any other documents between us represent the entire agreement between us relating to the transaction. The rights and obligations of these terms and conditions will survive the cancellation, termination, completion or fulfillment of any order made by you. To the extent permitted by law, if this contract is entered into in New Jersey, the prevailing party in any litigation shall be entitled to attorney's fees and costs of suit. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. This means that we agree to litigate individually and not as a representative of a class or as a member of a class.
We will not be liable or responsible to you for any failure or delay in fulfilling or performing any term of this Agreement when the failure or delay is caused by acts or circumstances beyond our reasonable control. This includes acts of God, flood, fire, hurricane, tornado, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national or state emergency, revolution, insurrection, epidemic, pandemic, lockouts, shortages of labor, raw material, production, or transportation facilities, strikes or other labor disputes, other contingencies of manufacture or shipment, or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials from our usual sources of supply, materials or telecommunication breakdown or power outage. In the event of any delay in our performance to any cause beyond our reasonable control, we will have such additional time for performance as may be reasonably necessary under the circumstances. You acceptance of any product having been ordered by you constitutes a waiver by you of any claim for damages on account of any delay in delivering that product to you by us.
Privacy Policy and Communication Consent
We value your privacy. Our collection, use, and sharing of personal information is described in our Privacy Policy, available at shop.ashleyne.com, which is incorporated into these Terms by reference. By engaging with our services or providing your information, you acknowledge and agree to the terms of our Privacy Policy.
By providing your contact information, you consent to receive transactional and, where permitted by law, promotional communications from us, including via email and/or text message. You may opt out of marketing communications at any time by following the unsubscribe instructions included in those communications or by contacting us directly.
Acknowledgment and Acceptance of Purchase Terms
By placing this order and accepting this Agreement, you acknowledge that you have reviewed and understand the items purchased, including their descriptions, quantities, and prices, as well as any applicable taxes, delivery charges, and fees. You confirm that you are knowingly and voluntarily entering into the Agreement and agree to be bound by its terms and conditions. You represent that you have personally reviewed the purchase order in detail. You have ensured that the items, part numbers, and pricing matches those items which you selected.
